When is the Apostille really needed?
What is the Apostille?
The Apostille is an authentication stamp that certifies the signature of the official who issued or authenticated a document. It can be applied to both the original document and the sworn translation, depending on the destination country's requirements.
When is it needed?
The Apostille is ONLY needed when the document is intended for use OUTSIDE the country of issue. For example, an Italian birth certificate to be used in the USA requires the Apostille on the original document before the sworn translation.
EU Documents: Apostille NOT Required!
For documents circulating between EU member states, EU Regulation No. 1191/2016 on debureaucratization applies. This regulation eliminates the need for Apostille or legalization for many public documents, including civil registry certificates, criminal records, and academic qualifications.
EU Regulation 1191/2016
This regulation simplifies the circulation of public documents between EU countries, eliminating the need for Apostille for birth, marriage, death, residence certificates, criminal records, and other civil registry documents between member states.
At EU level, the Apostille is NOT required for public documents circulating between EU member states, thanks to Regulation 2016/1191. The Milan legalization office at the Public Prosecutor's Office, in fact, refuses to apply the Apostille on documents destined for other EU countries, correctly applying European regulations.
